DA: Use of deadly force by police ‘justified’ in Braintree shooting

BRAINTREE, Mass. — The Norfolk County District Attorney says officers from the Braintree Police Department were justified in their use of deadly force during a shootout in June.

Andrew Homen, 34, of Brockton was killed after he opened fire on the officers, the DA said.

Officer William Cushing and Officer Matthew Donoghue each sustained multiple gunshot wounds in the confrontation, and Cushing’s K-9 partner ‘Kitt’ was killed.

“I have reviewed all of the available testimonial and physical evidence in this matter, including the recently completed ballistics and autopsy reports. I have assessed all of that evidence in light of the factors necessary for police use of force to be justified,” District Attorney Morrissey said, “I am satisfied that Braintree Police were justified in their use of force when Andrew Homen began firing at them, wounding two and killing their search dog.”

It all started after Braintree Police got a 911 call at about 12:45 p.m. on Friday, June 4 for a domestic dispute.

Investigators said Homen took off into the woods armed with two guns.

Once the police K-9 unit arrived, they went in to find him. At the time, investigators say the officers were “ambushed” by Homen and officers returned fire.

K-9 Kitt was a 12-year veteran of the force. Police say Kitt diverted the attention of the armed suspect away from his handler.

A memorial for Kitt was held weeks later at Gillette Stadium on June 22.
