Family: 'Lack of accountability' in OUI crash that killed father of 3

READING, Mass. — A local woman with a history of drunk driving offenses returned to court Tuesday for a deadly crash that killed a father of three last year.

Police said Lynn DeWolfe, of Tyngsborough, was driving impaired when she crashed into a car on I-95 in Reading last August.

That car spun out of control hitting and killing Christopher Weisz.

The Bedford father of three was riding his motorcycle to work when he was killed.

This weekend, the Boston Globe revealed new details that show the crash could have been prevented.

They reported DeWolfe was stopped by a Massachusetts State Police trooper after multiple drivers called 911 saying she was out of control. The trooper didn’t observe signs of impairment and let her go.

About 20 minutes later police said she slammed into a car and triggered the fatal crash. State police are now accused of withholding the initial 911 calls from prosecutors.

An internal investigation showed the trooper who pulled DeWolfe over couldn’t arrest her without probable cause, but should have written up a report.

Before the deadly crash DeWolfe had two drunk driving convictions on her record and a history of violations.

She also had a breath test device installed in her car.

Peter Ricci, a family friend, released a statement following court:

"The state police had the opportunity to take this driver off the roads and it would have prevented his death. The people and or institutions responsible for these mistakes need to be held accountable."

Now, State Police Colonel Kerry Gilpin has ordered an "independent and thorough investigation to determine how and why" all relevant information about DeWolfe was not shared with the Middlesex District Attorney's Office.
