Prominent defense attorney charged with rape

BOSTON — A prominent Boston attorney has been arrested on two counts of rape, and it’s not the first time he’s faced that charge.

FOX25’s Jacqui Heinrich learned this is the fourth time Gary Zerola has been accused of sex assault.

Zerola hid from cameras, wedged behind his attorney in court. He’s been acquitted of rape three times in the past. Two rape cases in 2009 in Boston, and another in Florida that same year.

Wednesday’s charges stem from a Nov. 10 incident at 6 a.m. that authorities aren’t revealing too many details about, except that Zerola and the victim know each other. His attorney, Joseph Krowski Jr., said the woman is lying.

"I don’t know what’s motivating this young woman. I don’t know if she’s looking for money. I don’t know if she's looking for her 15 minutes of fame. I don’t know if she told an initial lie that’s spiraled out of control on her, but I do know she’s lying,” he said.

In court, prosecutors argued Zerola should have strict bail conditions citing that 2009 case where he was ordered not to leave the state, but went to Florida where he was accused again of sex assault.

Krowski said the past cases, none of which resulted in convictions, should have no bearing on bail after the latest allegations.

“There is absolutely no incentive for him to flee, he’s got his professional career, he’s got his reputation and he’s got no history of flight,” he said.

Zerola was ordered to wear an ankle bracelet and the case will be tried in January.
