Death penalty hearing underway for convicted murderer Gary Lee Sampson

BOSTON — Lawyers for convicted killer Gary Lee Sampson are arguing against a death sentence saying he will die of health problems in prison anyway.

Sampson was convicted of killing three men in 2001, but his death sentence is scheduled to be re-tried this fall.

Sampson's lawyers say he suffers from a heart condition, high blood pressure, hepatitis and liver disease.

They claim a death sentence would be symbolic, and a waste of time and money.

FOX25 spoke with one of the victims’ father said he who does not see things the same way.

“He took what was remaining of the lives of two people, as well as Jonathan's whole life,” Michael Rizzo said. “He's a triple murderer and that’s it. All the rest of it is just speculation on their part.

Prosecutors say the terminally ill are not protected from the death penalty.
